General Terms and Conditions (GTC)

 

1.   Scope of application: These general terms and conditions of sale (GTCS) apply to all sales concluded between KANOM sarl-s (hereinafter referred to as the “Seller”) and its customers (hereinafter referred to as the “Customers”), whether they are companies (B2B) or consumers (B2C), on the website www.kanomletz.com (hereinafter referred to as the “Site”).

 

2.   Products: The Seller offers for sale food products intended for human consumption. The characteristics of the products, their prices and their availability are indicated on the Site. The Vendor reserves the right to modify product information at any time, but undertakes to honour orders placed by Customers at the time the order is placed.

3. Prices and payment: Product prices are quoted in euros and include all taxes. Delivery charges are not included in the price of the products and are invoiced in addition. The customer undertakes to pay the total amount of the order when validating it. Payment is made by credit card for B2C customers. For companies (B2B), payment is made by credit card, bank transfer or bill of exchange not accepted.

 

4. Free shipping: The Seller offers free shipping for orders over a certain amount. For B2C customers, carriage-paid applies to orders of 80€or more including VAT. For business customers (B2B), free shipping applies to all orders of €500 or more (excl. VAT).

5. Order: The Customer places an order online by adding the desired products to the shopping basket, providing the required information and validating the order. Before validating the order, the Customer may check the order details and correct any errors. Once the order has been validated, the Customer will receive an order confirmation e-mail summarizing the information relating to the order.

 

6. Delivery: The Vendor undertakes to deliver products within the times indicated on the Site, except in cases of force majeure or events beyond its control. Delivery charges and terms are indicated on the Site. The Customer is required to check the condition of the products upon receipt and to report any anomaly as soon as possible. In the event of late delivery, the Customer may contact the Vendor for further information.

7. Right of withdrawal: B2C customers have a right of withdrawal within fourteen (14) days of receipt of the products. To exercise this right, the Customer must inform the Vendor of his decision by any means (e.g. e-mail or letter). Products must be returned in perfect condition and in their original packaging, at the Customer's expense. The Vendor will then refund the price of the products within a reasonable period of time.

 

8. Liability: The Vendor is responsible for the compliance of the products sold on the Site with the legal provisions in force. The Vendor cannot be held responsible for indirect or immaterial damage resulting from the use of the products. The Vendor's liability is limited to the amount of the order placed by the Customer.

9. Protection of personal data: The Seller collects and processes customers' personal data in accordance with current legislation and its privacy policy. Customers may exercise their rights of access, rectification, opposition and deletion of data concerning them by contacting the Vendor.

 

10. Intellectual property: All elements of the Site, whether visual or audio, are protected by copyright and are the exclusive property of the Vendor. Any reproduction, even partial, is strictly forbidden.

 

11. Applicable law and disputes: These GTC are governed by Luxembourg law. Any dispute relating to the validity, interpretation or performance of these GTS shall be subject to the exclusive jurisdiction of the courts of the place where the Seller's registered office is located.
